Terms and Conditions

  1. When you place an order with Black Market Sake Pty Ltd (Us/We/Our) the customer (You/r) are agreeing to pay the invoice in full as COD (Cash on Delivery), unless you request in advance that you wish to apply for a Credit Account and been notified by us that you have been accepted. We reserve the right to, at any time, cancel a delivery or a credit account, we will however notify you in writing where possible if this happens.
  2. All approved Credit Accounts are agreeing by making an order from Black Market Sake Pty Ltd to pay the invoice total in full within 21 days of the invoice date. EFT details are included on all invoices, it is your responsibility to notify us of any banking issues. We reserve the right to change the credit days, but all invoices will clearly state the Due Date/Terms.
  3. Until you have paid the invoice in full, all stock remains the property of Black Market Sake Pty Ltd and we, or our elected agent, have the right to enter any premise where the stock may be held to take back stock (you will still be liable for the invoice total, less goods that can be resold, plus all associated costs). However, you are also fully responsible and liable for the delivered stock until you have paid for it in full.
  4. If you don’t pay your invoice in full within 21 days we reserve the right to add a 3% per month interest/account fee to your invoice total, until you pay in full. We may also place a temporary/permanent stop on your credit account. If you need to notify us about any problems with the delivery of stock or invoice you must tell us within 24 hours so that it can be verified/rectified.
  5. Acceptance of Orders and Credit Accounts are based on the information provided by you, so you will be held accountable for inaccuracies. Also if any of the details of your business, that would affect our business, change (not limited to, but such as, change of ownership) you must notify us immediately of this change. Until you pay all invoices in full and notify us of any changes, you are still legally responsible for all current and future stock and/or debt.
  6. If we need to involve any agency or lawyer to recover stock or money from you, you agree that you will also be responsible for their and/or our costs.
  7. We reserve the right to enforce terms or conditions even if we have waived them in the past.
  8. Prices for goods and associated services are subject to alteration without notice, if required. The L.U.C. (Landed Unit Cost) of Sake currently includes the 29% WET (Wine Equalisation Tax) we collect for the government. A 10% GST (Goods and Services Tax) will be added to the invoice according to Australian taxation regulations. If taxation rulings change, Black Market Sake Pty Ltd may be required to change relevant charges or information and will assume that all businesses will keep themselves up to date with all regulations and taxation rulings.
  9. By ordering stock from Black Market Sake Pty Ltd you are agreeing that you have read and accepted all of the Terms and Conditions.
